Private Well Testing

The Private Well Testing Act of 2001 went into effect on September 14, 2002.

PLEASE NOTE THE FOLLOWING CHANGE IN THE PRIVATE WELL TESTING REGULATIONS:

The New Jersey Department of Environmental Protection Commissioner, Bradley Campbell, has announced today that “Grand fathering” will be permitted under the Private Well Testing Act.Commissioner Campbell announced contracts of sale entered into prior to September 14, 2002 will not be required to comply with the new law. The Private Well Testing Act will specifically apply to contracts of sale that are signed the date of September 14, 2002 and thereafter.

We will continue to update you on any further regulatory amendments.

The NJ Attorney General's Office has given formal agency advice that the law applies to real-estate transactions where the sales contract is executed on or after the effective date of the statute, September 14.Thus, private well testing is not required by statute for real-estate transactions already under contract when the statute goes into effect. This advice will be found on the NJ DEP web site at: http://www.state.nj.us/dep/pwta/ this link.
