Information Regarding NAR’s Clear Cooperation Policy

The National Association of REALTORS® recently passed the Clear Cooperation Rule. The policy was proposed to address the growing use of off-MLS listings, to strengthen cooperation, and ensure REALTORS® have access to all available inventory. NAR’s Advisory Board concluded that leaving listings outside of the broader marketplace excludes consumers and undermines REALTORS®’ commitment to provide equal opportunity to all. The policy requires listing brokers who are participants in a multiple listing service to submit their listing to the MLS within one business day of marketing the property to the public. The policy doesn’t prohibit brokers from taking office exclusive listings, nor does it impede brokers’ ability to meet their clients’ privacy needs. The policy was approved by a large majority of the vote of the NAR Board of Directors.

Text of Clear Cooperation Rule
Within one (1) business day of marketing a property to the public, the listing broker must submit the listing to the MLS for cooperation with other MLS participants. Public marketing includes, but is not limited to, flyers displayed in windows, yard signs, digital marketing on public facing websites, brokerage website displays (including IDX and VOW), digital communications marketing (email blasts), multi-brokerage listing sharing networks, and applications available to the general public.


The new Clear Cooperation Rule will be effective January 1, 2020. If you observe the mandatory submission time to publish a listing in the NJMLS, nothing changes because you are already complying with the new rule. The change impacts Office Exclusives with a Waiver of Broker Cooperation. Here are answers to some questions you may have:

Are Exclusive Right to Sell or Exclusive Agency listings I enter into the NJMLS impacted by the Clear Cooperation Rule?
Exclusive Right to Sell listings and Exclusive Agency listings entered into the NJMLS are not impacted by this rule. The NJMLS already requires listing be published within 24 hours; therefore, the rule does not apply. Continue to submit these listings as you have been, according to the Rules and Regulations set forth by the NJMLS. As a reminder, if you have a listing that is published in the system but cannot be shown for more than three calendar days from the listing start date, a Delayed Showing form must be completed and uploaded into the system as an Associated Document, in compliance with the NJMLS Delayed Showing Policy.

How does this rule impact Office Exclusive listings submitted to the NJMLS with a Waiver of Broker Cooperation?
An Office Exclusive that is submitted to the NJMLS, where the listing office is not cooperating with other brokers, is not affected as long as the listing is not publicly marketed. If any public marketing takes place, the Clear Cooperation rule then applies and the listing office must cooperate with other Brokers.
Note:  The Waiver of Broker Cooperation form has been updated to reflect this new policy.

How does this rule impact Office Exclusive listings submitted to the NJMLS with a Non-Dissemination form?
An Office Exclusive that is submitted to the NJMLS with a Non-Dissemination form is not impacted as there is already an agreement to cooperate with other Brokers.

Does the Clear Cooperation Rule apply to all property categories submitted to the NJMLS?
The rule applies to Single Family Homes (Residential), Condo/Coop/Townhouse, and 2–4 Family listings in our required market areas.
This rule does not apply to Rentals, Commercial, Business, and Land listings, or to listings outside of the NJMLS Market Area.

Fines will be imposed for first and subsequent offense:

Failure to comply with Clear Cooperation Rule
$250.00 and $500.00

This fine will be imposed monthly until the listing has been submitted to the NJMLS.

Reminder:  Brokers May Order KeyBoxes Online

Enjoy the convenience of having KeyBoxes delivered to your office! Just a reminder that Designated Realtors may now have Supra KeyBoxes delivered by courier to their office. The menu item is available for Brokers only under the Listing Maintenance tab in XL Paragon. Choose this option, submit the form, and KeyBoxes will be delivered as follows:
  • Order up to 4 boxes for a $10 delivery charge.
  • Orders placed Monday through Thursday by 11:00am will be delivered the next business day.
  • Orders placed on Friday will be delivered on Monday.
  • Orders placed on Saturday or Sunday will be delivered on Tuesday.
  • A signature will be required at delivery.
  • Call the NJMLS for pricing on larger orders.
